Terms And Condition

1. Introduction

The following Terms and Conditions shall govern all transactions between the Customer and Canada Premium Gold (CPG). It is the Customer’s responsibility to confirm that their transaction conforms to the Terms and Conditions as set out in each of our products.

2. Application and Accounts

Customers wishing to purchase from or sell to Canada Premium Gold must have an account. Opening an account is free and easy, and you, the person opening the account can place your first order immediately. Orders can be placed online with Canada Premium Gold (CPG) 24 hours a day, 7 days a week. For Customers who currently have an account, CPG restrict the purchase or sale of Precious Metal Bullion, Precious Metal Products or Scrap Metal, whether online or by telephone. Depending on the type of account to be opened, individuals, business entities or trusts can create an account with CPG online, by telephone or in person. Additional information regarding the application forms to be completed and the documentation requirements for each type of account can be found on CPG’s website.

3. Laws and Legislations

These Terms and Conditions and any transaction entered into pursuant hereto, shall be governed by and interpreted in accordance with the laws of the province of Ontario, Canada and the federal laws of Canada applicable therein.

4. Purchases and Orders

Each form of payment is subject to the following terms and limitations for each payment type.

  1. Cash or Debit (In Store Payments)-

Cash or debit is accepted for orders of any amount. Orders booked online to be in CPG store must be completed within two business days of your Order Confirmation. Call ahead to book an appointment. Single cash transactions of $10,000 or greater, or multiple smaller transactions in cash within a 24 hour period that total $10,000 or more, will require you to provide one piece of valid government issued photo identification. You will also be required to complete our ‘Large Cash Transaction Report’ in compliance with all federal FINTRAC guidelines. FINTRAC guidelines do not apply to amounts spent using debit cards.

  1. Interac Online –

Online debit payments are accepted for orders up to $50,000. Prior to attempting a payment by debit card, please contact your banking institution to confirm your transaction limit to avoid delays. Most financial institutions will be able to accommodate large debit transactions if arranged in advance. Please note that you will be redirected to the Interac Online payment portal to complete your transaction. Once completed, you will be redirected back to Canada Premium Gold (CPG).com to complete your order

Bank Wire Trasnfers is preferred and recommended form of payment for the fastest processing and delivery of your order. There is no maximum value for wire transfer payments. Wire transfers issued by a Canadian financial institution must be completed within one business day of receipt of your Order Confirmation. Wire transfers issued by a United States financial institution must be completed within two business days of receipt of your Order Confirmation.   1. PayPal –

PayPal is accepted for orders of any size. Please note that Canada Premium Gold (CPG) can only accept orders that are shipping to PayPal Verified shipping addresses. In order to purchase items through Canada Premium Gold (CPG) using PayPal, you are required to create a PayPal account. When selecting PayPal as your method of payment, you will be redirected to the PayPal website where you will be prompted to log in to your PayPal account and process the payment. After your payment has been processed, you will be redirected back to Canada Premium Gold (CPG) to finalize your order. If you do not currently have a PayPal account, you will be required to create one at the checkout process.

  1. Credit Cards –

VISA, MasterCard and American Express credit card are accepted for orders up to $5,000. Canada Premium Gold (CPG) currently does not accept Pre-Paid Credit Cards or Credit Card Cheques as a method of payment. Items purchased by credit card do not receive the 4% discount (or Cash Price).

Orders paid by this method will only be shipped to the verified billing address matching the credit card information. Verified by VISA, MasterCard Secure Code and American Express SafeKey – these programs are in place to help make shopping online more secure. Please note that Canada Premium Gold (CPG) is not involved in the authentication / verification process and is at the sole discretion of your credit card provider. Please be advised that Canada Premium Gold (CPG) reserves the right to request additional Government Issued Photo Identification when a potential fraudulent transaction is under investigation.

  1. Electronic Bill Payment –

Electronic Bill Payment is accepted through Canadian financial institutions for payments up to $10,000. Orders paid by this method will be held for up to 10 business days prior to processing to allow for full clearance of the payment through the banking system. To complete a payment via your financial institution’s Electronic Bill Payment system, please set up Canada Premium Gold (CPG) Corp. as your bill payee.

Personal and Business Cheques are accepted for purchases up to $5,000. The cheque must be postmarked within one business day of the time of your Order Confirmation and must be received by Canada Premium Gold (CPG) within five business days of receipt of your Order Confirmation.

Orders paid by this method may be held for up to 30 calendar days prior to processing to allow for full clearance of the cheque through the banking system. Canada Premium Gold (CPG) will only accept cheques from Canadian financial institutions which have pre-printed account information. Please ensure all cheques are made out to the following: “Canada Premium Gold Corp.”

Bank Drafts issued by Canadian and United States financial institutions are accepted for payments up to $100,000. The draft must be postmarked within two business days of the time of your Order Confirmation and must be received by Canada Premium Gold within five business days of receipt of your Order Confirmation. Orders paid by bank draft issued by a Canadian financial institution are subject to a five business day holding period prior to processing to allow for full clearance of the draft through the banking system. Orders paid by bank draft issued by a United States financial institution or a Credit Union are subject to a 10 day holding period prior to processing to allow for full clearance of the draft through the banking system. Please ensure all bank drafts are made out to the following: “Canada Premium Gold (Corp.”

5. Order Refusal

Upon making an order with Canada Premium Gold (CPG), you have entered into a binding agreement to purchase goods that cannot be altered or revoked by you. Customer orders are normally accepted, but are subject to acceptance or rejection by Canada Premium Gold (CPG) in its discretion. Canada Premium Gold (CPG) will usually notify you of its acceptance of your order within 24 hours.

Regardless of changes to the precious metals market, the prices set out in your Order Confirmation are locked. Your purchase is now your investment, the fluctuating value of which is entirely your responsibility. All payments to Canada Premium Gold (CPG) are subject to time-sensitive conditions, as detailed below.

6. In Store Pick-Up

When picking up orders in-store, you will need to bring your Pick-Up Confirmation and provide one piece of government issued photo identification before Canada Premium Gold (CPG) can release your merchandise. There are no additional fees for in-store pickups.

8. MARKET LOSS POLICY

If your purchase is cancelled and the value of your purchase is lower at the time of cancellation, the full difference between Canada Premium Gold (CPG)’s current selling price and the original price of your order will be added to the $100 minimum Cancellation Fee. Should the value of the items you have ordered be greater, any increase in value will not be credited to your account and will remain the property of Canada Premium Gold (CPG). Canada Premium Gold (CPG) reserves the right, at our sole discretion, to honour orders for which we have received a late payment, if doing so is more advantageous to Canada Premium Gold (CPG).

9. SHIPPING POLICY
Canada Premium Gold offers Free Shipping on all orders over
$500 within Canada (fully insured).

All orders placed with Canada Premium Gold are shipped fully insured by UPS (within Canada) or FedEx/UPS (to the United States). Based on location, Canada Premium Gold (CPG) also has the right to ship orders fully insured via Canada Post or United States Postal Service. For large orders or orders being shipped to commercial residences, customers may request shipment via Brinks at an additional cost. The shipping and insurance fees are calculated individually for each order. All shipments will require an adult signature upon delivery.

Customers may also ship orders to courier pickup locations, where your signature will be required upon pick up. We will not accept responsibility for lost or damaged shipments if you have instructed your package to be left without a signature, or if you have made arrangements for your package to be left with a neighbor, building superintendent or other party.

NOTE: once the shipment is signed for at the customers’ listed shipping address, the package will then be considered fully delivered and is no longer the responsibility of Canada Premium Gold (CPG) Corp.

Canada Premium Gold (CPG) will not ship any order to a Post Office Box. Orders will only be shipped to the verified address associated with your credit card when paying by credit card. All other payment types will be shipped to the shipping address provided by the customer.

Your order will be processed and shipped typically within 1-3 business days of your payment being cleared by Canada Premium Gold (CPG). Within Canada you can expect delivery within 1 – 2 business days for gold, lightweight packages, and low-value silver orders. Heavy silver shipments (100 oz or more), will be delivered within 2 – 5 business days.

Canada Premium Gold (CPG) is unable to provide tracking numbers on bullion shipments due to insurance obligations, unless the package has not been received after a period of 21 business days from the shipment date whereas then the package will be under further investigation.

10. INTELLECTUAL PROPERTY, TRADEMARKS AND LOGOS

All trademarks presented on or via the site are owned by their respective owners and may not be used by you in any way. No intellectual property of any nature contained within or via the site may be copied, published, or broadcast in any way without the written permission of the content owner. All content provided within or via the site is protected by various Canadian, U.S. and international copyright laws, patent laws, trademark regulations and laws, and various intellectual property laws and international treaties, agreements or licenses. No party who utilizes the website may attempt to tamper with, modify, reverse engineer, gain unauthorized access or modify any software used in Canada Premium Gold’s programs or website.

11. SCRAP METAL
  1. SCRAP METAL

Scrap metal sent to Canada Premium Gold will be tested using one, or a combination of the following methods:

Scrap metal that is tested at Canada Premium Gold will be damaged in the process of being assayed. As a result of the type of testing Canada Premium Gold does, if a customer requested to have their scrap metal returned to them after testing, it will not be returned in the same condition as when it was received by Canada Premium Gold. Scrap metal that is requested to be returned to the customer prior to completing a transaction will only be returned once payment of applicable shipping costs, and fees are paid in full. Scrap metal shipped to Canada Premium Gold can be rejected if Canada Premium Gold determines that metal contaminants are outside of acceptable tolerances.

Once a customer’s scrap metal has been tested, Canada Premium Gold will contact the customer to go forward with completing the transaction.

12. TESTING AND MELT LOSS

The testing, melting and refining of scrap metal will result in a decrease of gross weight, due to the high temperatures, impurities and certain alloys can be eliminated. A decrease in weight will also occur once all gemstones, enamel, imbedded metals and other misc. items are removed and or retained in borax.

13. DENTAL

Canada Premium Gold reserves the right to deem whether or not it is safe to melt and assay a customer’s dental scrap. Dental scrap may lose as much as 50% of its gross weight in a melt, depending on the amount of enamel and other impurity’s present in the materials. In the case that Canada Premium Gold does not deem it is safe to melt the customers dental scrap, Canada Premium Gold will purchase the dental scrap on a piece by piece basis.

14. RISK

All customers should do their due diligence and cautiously consider the volatility of precious metals before making any decisions that may affect their financial situation.

The purchase and sale of precious metals can involve a high degree of risk and depending on a customer’s financial situation, is not suitable for all persons. There is no guarantee of yield or return when purchasing and selling precious metals.

15. DISCLAIMER OF WARRANTY

The site and all content via the site are provided to you “As is, Where is”, without any warranty of any kind, expressed or implied. Canada Premium Gold issue no warranty whatsoever and do not make any representation or warranties regarding the availability, sustainability, reliability, merchantability, non-infringement, capability, usefulness or fitness for any general or particular purpose of the site, or the tools, products or services herein supplied or sold regarding the characteristics of services provided by or through the site, or regarding the timeliness, accuracy or usefulness of information obtained from or through the site

16. NON-PAYMENTS AND CANCELLATIONS

If payment is not received within the period of time stated above, or if your mailed payment is postmarked more than one business day from the time of your order, Canada Premium Gold has the right to cancel your order. Your credit card will be charged a cancellation fee in a minimum, non-negotiable amount of $100 plus any applicable market loss according to our Market Loss Policy.

Should Canada Premium Gold is unable to collect your full cancellation fee, your account with Canada Premium Gold will be suspended until the full fee is collected. Should we be unable to collect the cancellation fee we reserve the right to take additional measures to collect the cancellation fee, including sending your account to a collections agency or the right to offset if applicable. Any payments that we have received for cancelled orders will be refunded by cheque and sent by regular mail at our cost.

17. RIGHT TO CHANGE OF TERMS

Canada Premium Gold reserves the right to change these Terms and Conditions at any time without notice.
